Are you required to probate a will in Texas?
Question: In Texas do we HAVE TO probate my mother's will? There is only my sister and myself as beneficiaries. My mother has one house and one condo, the house goes to me and the condo goes to my sister. Do we have to probate the will to be able to transfer the properties?
Answer:
If there is a will it probably should be probated -- that is the reason for the will! It isn't costly. If there is no will, it can be more expensive.
Advice: get a will and relax. If your loved one passed away and owned property, probate is usually necessary. Hire a lawyer.
